Criminal Law Areas

At Farrell Lusher Solicitors, we advise and act in matters including:

  • Drink Driving Matters: Drink driving matters can be a 'prescribed concentration of alcohol' (PCA) offence, a 'driving under the influence' (DUI) offence, refusing or failing to give a breath analysis or blood sample, and dangerous driving involving alcohol. The severity of the offence may depend on the amount over the alcohol limit, the factual circumstances and the history of offences.

  • Speeding, Driving & Licence Appeals: Some decisions in respect of licensing and speeding can be appealed while other types of decisions cannot. There are a number of factors that are considered when appealing a suspension, including the circumstances of the offence, your traffic record/character and your need for a licence. You only have 28 days after receiving the letter from the RMS notifying you of the suspension to lodge your appeal. If you do not lodge your application in time, the court cannot hear your appeal, and you must serve the suspension. Once you lodge an appeal, you are able to continue to drive until your appeal is heard. It is important that you consult an experienced professional to determine the possibility of the success of an appeal, so as to possibly save you time and money.
  • Disputes with Police: If you have been arrested or called in for questioning by the police, you should understand your rights. Sometimes you find you are in circumstances where you have experienced police misconduct, such as coerced false confession, intimidation, false arrest, false imprisonment, falsification of evidence, police perjury, witness tampering, police brutality police corruption, racial profiling or unwarranted property searches. We can help you navigate the right path through your police dispute and make sure you are treated the way you should be treated.

  • Commonwealth Offences: Commonwealth offences can cover a range of alleged criminal behaviour, from minor tax and customs offences to serious crimes under the Criminal Code Act, including child sex offences by Australians in foreign countries, cybercrimes committed against Commonwealth government departments, drug importation and exportation, people smuggling, human trafficking, terrorism, fraud against the government (e.g. Centrelink, Medicare or the Australian Tax Office) and threats made against government officials. It is essential that you seek superior representation from criminal lawyers who are experienced in defending Commonwealth prosecutions.
  • Apprehended Violence Orders (AVOs): There are two types of AVO orders, ADVO (Apprehended Domestic Violence Order) and APVO (Apprehended Personal Violence Order). An ADVO refers to the protection of a person where they are in a domestic relationship with the accused offender, whilst an APVO relates to the protection of a person where they are not in a domestic relationship with the other party, for example co-workers, neighbours, etc. Being the subject of an AVO, or an unfair AVO, can take a significant toll on your life. An experienced criminal defence law can help you and your family to get on with your lives.

  • Other Criminal Offences: Our firm is experienced in successfully representing defendants on charges of indecent assault, sexual assault, assault and manslaughter, drug offences and dangerous driving causing death.

Going to court can be nerve-racking, but having a strong and compassionate legal team behind you can make the experience significantly easier to deal with. Our experienced senior criminal law solicitor, Mr Greg Reynolds, assisted by solicitor Hayley Challender, has significant experience successfully representing clients in all areas of criminal law, including in Local and District Court hearings, and in District Court appeals. You can feel at ease with us that you are in capable hands, and that our team will handle your case with commitment and care.
